10th January 2009

Dear Sir,

Further to the report in your paper dated 9th January 2009 regarding the December meeting of Manorbier Community Council I would wish to correct the statement in the report that I was against the "appointment of a clerk".
My objection was to the appointment of a "permanent clerk" whilst the council is being taken to an employment tribunal by the previous clerk for unfair dismissal. I had no objection to the council appointing anyone on a temporary basis to the position. The employment tribunal has taken approximately two years, which in itself must be a record and Manorbier Community Council and councillors I felt were not acting in a proper manner to an employee it had dismissed.
The council should be mindful that any settlement result of the employment tribunal, especially if the council is found to be at fault over the dismissal could result in the reinstatement of the former employee, the council as a responsible employer funded by the taxpayers of Manorbier would therefore I assume offer the employee reinstatement.
Councillors at the meeting on 5th January 2009 commented when raising the precept of the council for the year 2008/2009 from £17,000 to £31,000 that it would be getting the blame for the previous council's decisions. I would suggest that no one is going to blame them for the actions of the previous council only their actions/decisions since May 2008 especially if they have prevaricated over the employment tribunal, resulting in any extra costs to the council and therefore the taxpayers of Manorbier.

Yours sincerely,

Cllr Malcolm Calver
